1. Acceptance of Terms

By accessing and using Aura ("the Service"), including our website at www.aura.day and our mobile applications, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Eligibility

You must be at least 13 years of age to use the Service. If you are between 13 and 17 years old, you may only use the Service with the consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf. By using the Service, you represent and warrant that you meet these eligibility requirements.

3. Description of Service

Aura is a personality quiz application that reveals users' element-inspired personality types through interactive assessments. The Service includes quiz functionality, result storage, social sharing features, AI-generated daily readings and yearly forecasts, and paid subscription access to premium features.

4. User Accounts

To access certain features of the Service, you must create an account by providing a valid email address. You are responsible for:

• Maintaining the confidentiality of your account
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Providing accurate and current information

5. User Content

By using the Service, you grant Aura a non-exclusive, worldwide, royalty-free license to use, store, and display your quiz responses, results, and other inputs (including aura type and zodiac data) for the purpose of providing and personalizing the Service, including generating AI-powered content such as daily readings and yearly forecasts. You retain all rights to your content and may delete it at any time by deleting your account.

6. Paid Subscriptions and Billing

Aura offers paid subscription plans that provide access to premium features. By subscribing, you agree to the following:

• Subscriptions automatically renew on a weekly basis unless canceled before the end of the current billing period
• Pricing is subject to change; we will provide reasonable notice of any price changes before they take effect
• You are responsible for all charges incurred under your account
• Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time

7. Free Trials

Aura may offer a free trial period (e.g., 3 days on mobile) for new subscribers. At the end of the free trial, your subscription will automatically convert to a paid subscription at the then-current price unless you cancel before the trial period ends. You will not be charged during the free trial, but you must cancel before it expires to avoid charges.

8. Third-Party Payment Processors

Payments for subscriptions are processed by third-party payment providers, including:

• Apple App Store (for iOS purchases)
• Google Play Store (for Android purchases)
• Stripe (for web purchases)

Each payment processor has its own terms of service and privacy policy. Refunds for purchases made through the Apple App Store or Google Play Store are governed by their respective refund policies. Aura does not directly process or store your payment card information.

9. Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to hack, disable, or otherwise interfere with the Service
• Create multiple accounts for fraudulent purposes
• Harass, abuse, or harm other users
• Violate any applicable laws or regulations
• Scrape or copy content without permission

10. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, and software, are the exclusive property of Aura and are protected by international copyright, trademark, and other intellectual property laws.

11. AI-Generated Content

Certain features of the Service, including daily aura readings and yearly forecasts, are generated using artificial intelligence. This AI-generated content is provided solely for entertainment and self-reflection purposes. It does not constitute professional advice of any kind, including but not limited to astrological, psychological, financial, medical, or legal advice. Aura makes no guarantees regarding the accuracy, completeness, or reliability of AI-generated content. You should not rely on such content for making any personal or professional decisions.

12. Quiz Results and Accuracy

The personality assessments provided by Aura are for entertainment and self-reflection purposes only. They are not scientific or psychological diagnoses and should not be used as a substitute for professional advice or treatment. Similarly, AI-generated readings and forecasts are not predictive or diagnostic in nature.

13. Mobile Application

If you access the Service through our mobile application, your use is also subject to the terms and conditions of the applicable app store (Apple App Store or Google Play Store). You acknowledge that these Terms are between you and Aura only, and not with the app store provider. The app store provider and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.

14. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices regarding the collection and use of your personal information.

15. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. AURA DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AURA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

17. Indemnification

You agree to indemnify and hold harmless Aura and its affiliates from any claims, losses, damages, liabilities, and expenses (including legal fees) arising out of your use of the Service or violation of these Terms.

18. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease.

You may delete your account at any time through the Service's settings. Upon account deletion, your personal data will be promptly removed from our active systems. Some data may be retained in backups for up to 30 days before being permanently deleted. If you have an active subscription, canceling your account does not automatically cancel your subscription — you must cancel your subscription separately through the applicable payment provider.

19. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

20. Binding Arbitration and Class Action Waiver

Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

• You and Aura each waive the right to a trial by jury and the right to participate in a class action, collective action, or representative proceeding
• The arbitrator may award the same relief that a court could, but only to the extent required to satisfy your individual claim
• Notwithstanding the above, either party may bring an individual action in small claims court for disputes within that court's jurisdiction
• You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of first accepting these Terms

21. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. To the extent that litigation is permitted under these Terms, you consent to the exclusive jurisdiction of the state and federal courts located in Delaware.

22. Severability

If any provision of these Terms is held to be unenforceable or invalid, that provision will be enforced to the maximum extent possible, and the remaining provisions will remain in full force and effect.

23. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Aura regarding your use of the Service and supersede all prior agreements, understandings, and communications.
